Terms of Use and Sale

2. Purpose and scope

These terms govern:
a) access to and use of the website;
b) the purchase of products offered through the website, including, without limitation, photographs, prints, editions, physical works, digital files and licences, where applicable; and
c) contact with Studio Barco or requests for creative, editorial or photographic services.

Commissions, productions, campaigns, shoots, bespoke licences or services quoted individually may also be subject to a separate proposal, quotation, contract or agreement. In the event of a conflict, the specific agreement shall prevail.

3. Use of the website

The user agrees to use the website lawfully, diligently and in compliance with applicable law, third-party rights and good faith.

The following are prohibited, among other things:
a) using the website for unlawful or fraudulent purposes;
b) introducing viruses, malware or any harmful code;
c) attempting to access restricted areas, servers, databases or systems related to the website without authorisation;
d) copying, reproducing, distributing or commercially exploiting website content without prior written authorisation, except where permitted by law.

4. Products, images and availability

Studio Barco endeavours to describe products as accurately as possible. However:
a) images on the website are for illustrative purposes only;
b) minor variations in colour, texture, framing, format or finish may occur for technical, screen, printing or production reasons;
c) all products are subject to availability.

Studio Barco reserves the right to modify, withdraw or update products, descriptions, editions, prices, formats or availability at any time.

5. Intellectual property

Unless expressly stated otherwise, all intellectual property and industrial property rights in the photographs, works, prints, files, designs, texts, layouts, logos and other content on the website belong to Studio Barco or to third parties who have authorised their use.

The purchase of a photograph, print, digital file or any other product does not imply any transfer of copyright, unless expressly stated otherwise in writing.

Unless otherwise specified in the product description or licence:
a) prints and physical works are purchased for private enjoyment or private display;
b) digital files and licences grant only the use expressly described in the product page, order or confirmation;
c) reproduction, resale, sublicensing, public distribution, commercial exploitation, modification, advertising or editorial use, and any other unauthorised use are prohibited unless authorised in writing.

6. Prices

Unless stated otherwise, prices are displayed in Swiss francs (CHF).

Prices include any applicable taxes or mandatory charges. Shipping costs, insurance, special packaging, customs duties, import charges or other additional costs, where applicable, will be shown separately before the purchase is completed.

Studio Barco reserves the right to correct obvious typographical, technical or pricing errors in product descriptions or offers.

7. Ordering process and conclusion of contract

To place an order, the customer must follow the online purchase process available on the website.

Before completing the order, the customer will be able to review and correct the data entered, the contents of the cart, billing or delivery details, the selected product, the quantity and the total price.

Placing an order implies acceptance of these terms and of the related policies published on the website.

The contract shall be deemed concluded when:
a) the customer submits the order using the final payment button indicating an obligation to pay; and
b) Studio Barco confirms receipt or acceptance of the order electronically.

Studio Barco may refuse or cancel an order before final acceptance for justified reasons, including, for example, product unavailability, an obvious pricing or description error, reasonable suspicion of fraud, inability to process payment, or incomplete customer information.

8. Payment

The available payment methods will be displayed during checkout.

Online payments may be processed by Stripe or other payment providers indicated during checkout. By making a payment, the customer also accepts the terms and policies of the selected payment provider.

Studio Barco shall not be liable for interruptions, errors or incidents attributable exclusively to the external payment provider, without prejudice to the customer’s mandatory legal rights.

9. Delivery

9.1 Physical products

Physical products will be shipped to the delivery areas indicated on the website or during checkout.

Shipping or delivery times are estimates unless expressly stated otherwise. They may be affected by made-to-order production, customs, carriers, public holidays, logistical issues or force majeure.

Unless expressly agreed otherwise, the customer shall bear any import costs, customs duties, local taxes or similar charges in the country of destination.

9.2 Digital products

If digital products are offered, they may be made available to the customer by download, link, email, restricted access or any other method specified at the time of purchase.

The customer is responsible for having the technical means necessary to access the digital product.

10. Commissioned works, made-to-order products and special editions

Custom works, made-to-order prints, commissioned pieces, limited editions or items produced specifically for the customer may be subject to additional specific conditions, including production times and cancellation restrictions.

11. Cancellations, returns and exchanges

Unless expressly stated otherwise in the relevant product page or unless mandatory law provides otherwise, purchases made through the website do not give rise to a general right of withdrawal for a mere change of mind.

In particular:
a) personalised products, commissioned works, made-to-order products or goods produced specifically for the customer cannot be cancelled or returned once the order has been confirmed or production has begun;
b) digital products cannot be returned once access, download or the licence has been provided;
c) physical prints, works and photographs may only be returned if they arrive defective, damaged, incorrect, or where required by applicable law.

If the customer receives a damaged, defective or incorrect product, they must notify Studio Barco without undue delay and, where possible, within 5 days of receipt, providing a description of the issue and, where possible, photographs of the packaging and the product.

If the claim is justified, Studio Barco may, at its discretion:
a) replace the product;
b) repair the defect where reasonable; or
c) refund all or part of the amount paid.

12. Warranties and liability

Studio Barco is liable in accordance with mandatory applicable law. To the fullest extent permitted by law, liability for indirect damages, loss of profit, loss of opportunity, loss of data, reputational harm or damages arising from improper use of the product or website is excluded.

The following shall not constitute a defect, among other things:
a) minor variations in tone, colour or finish resulting from screen display or the printing process;
b) non-material differences from illustrative images;
c) normal wear and tear, misuse, improper handling or incorrect storage by the customer.

Nothing in this clause excludes liability where such exclusion is not permitted by law.

13. External links

The website may contain links to third-party services or platforms such as Instagram, WhatsApp, Stripe or others. Studio Barco does not control such services and is not responsible for their content, availability, terms or policies.

14. Data protection and cookies

The processing of personal data and the use of cookies or similar technologies are governed by the Privacy Policy and the Cookie Policy published on the website.

15. Governing law and jurisdiction

These terms are governed by Swiss law.

To the extent permitted by law, any dispute shall be submitted to the competent courts of Zurich, Switzerland.

If mandatory consumer protection rules of the customer’s country of residence or non-waivable mandatory jurisdiction rules apply, such rules shall prevail to the relevant extent.
